서비스 이용약관

제1조 (목적)

이 약관은 (주)아르크리에이티브허브(이하 "회사")가 제공하는 감자 다이어리(AutoPixel) 서비스(이하 "서비스")의 이용과 관련하여 회사와 이용자 간의 권리, 의무 및 기타 필요한 사항을 규정함을 목적으로 합니다.

제2조 (정의)

1. "서비스"란 회사가 제공하는 AI 기반 자동 일기 생성, AI 이미지 생성, 타임라인 기록, 건강·캘린더 연동 등 감자 다이어리 앱의 모든 기능을 의미합니다.
2. "이용자"란 이 약관에 따라 서비스를 이용하는 자를 의미합니다.
3. "AI 생성 콘텐츠"란 외부 AI API를 활용하여 자동으로 생성된 일기 텍스트, 이미지, 운세 등을 의미합니다.
4. "수프(Soup)"란 서비스 내에서 사용되는 인앱 화폐를 의미합니다.
5. "유료 서비스"란 구독(Pro 멤버십) 및 수프 구매 등 결제가 필요한 서비스를 의미합니다.

제3조 (약관의 효력 및 변경)

1. 이 약관은 서비스 화면 또는 기타 방법으로 이용자에게 공지함으로써 효력이 발생합니다.
2. 회사는 관련 법령에 위배되지 않는 범위에서 약관을 변경할 수 있으며, 변경된 약관은 적용일 7일 전부터 서비스 내에 공지합니다.
3. 이용자에게 불리한 내용으로 약관을 변경하는 경우에는 적용일 30일 전부터 공지하고, 전자우편 또는 앱 내 알림 등을 통해 이용자에게 개별 통지합니다.
4. 회사가 제3항에 따라 변경된 약관을 공지 또는 통지하면서, 약관 변경 적용일까지 거부 의사를 표시하지 아니하면 동의한 것으로 본다는 뜻을 명확하게 고지하였음에도 이용자가 적용일까지 거부 의사를 표시하지 아니한 경우에는 변경된 약관에 동의한 것으로 봅니다.
5. 이용자가 변경된 약관에 동의하지 않는 경우, 변경된 약관의 적용일 이전에 거부 의사를 표시하고 이용계약을 해지할 수 있습니다.

제4조 (회원가입 및 계정)

1. 이용자는 이메일 또는 소셜 로그인(Google, Apple)을 통해 회원가입할 수 있습니다.
2. 이용자는 정확한 정보를 제공해야 하며, 타인의 정보를 이용한 가입은 금지됩니다.
3. 만 14세 미만은 서비스에 가입할 수 없습니다.
4. 이용자는 자신의 계정 정보를 안전하게 관리할 책임이 있으며, 제3자에게 계정을 양도하거나 대여할 수 없습니다.

제5조 (서비스의 내용)

회사가 제공하는 서비스는 다음과 같습니다.

1. AI 일기 생성: 이용자의 타임라인, 캘린더, 건강 데이터, 사진을 바탕으로 AI가 일기를 자동 생성합니다.
2. AI 이미지 생성: 일기 내용을 바탕으로 AI가 그림일기 이미지를 생성합니다.
3. 타임라인 기록: 이용자의 위치 이동을 자동으로 기록하여 하루의 동선을 정리합니다.
4. 오늘의 운세: 이용자가 입력한 이름, 성별, 생년월일을 바탕으로 AI가 운세를 생성합니다.
5. 데이터 연동: 건강 데이터(걸음수, 수면 등) 및 캘린더 일정을 연동하여 일기 콘텐츠에 반영합니다.

제6조 (회사의 의무)

1. 회사는 관련 법령과 이 약관이 금지하거나 미풍양속에 반하는 행위를 하지 않으며, 계속적이고 안정적으로 서비스를 제공하기 위하여 최선을 다합니다.
2. 회사는 이용자가 안전하게 서비스를 이용할 수 있도록 개인정보 보호를 위한 보안시스템을 갖추며, 개인정보 처리방침을 공시하고 준수합니다.
3. 회사는 서비스 이용과 관련하여 이용자로부터 제기된 의견이나 불만이 정당하다고 인정할 경우 이를 처리하여야 합니다. 이용자가 제기한 의견이나 불만사항에 대해서는 앱 내 고객 지원 또는 전자우편을 통하여 처리 과정 및 결과를 전달합니다.
4. 회사는 이용자가 원하지 않는 영리 목적의 광고성 정보를 발송하지 않습니다.
5. 회사는 서비스 제공에 필요한 설비를 유지·보수하고, 장애가 발생한 경우 지체 없이 이를 수리·복구하기 위하여 노력합니다.

제7조 (AI 생성 콘텐츠에 관한 사항)

1. AI 생성 콘텐츠는 외부 AI API를 통해 자동으로 생성되며, 회사는 생성된 콘텐츠의 정확성, 완전성, 적합성을 보증하지 않습니다.
2. AI 생성 일기 및 이미지에는 "AI로 생성됨" 표시가 포함됩니다.
3. AI 생성 콘텐츠의 저작권은 현행 대한민국 저작권법상 AI 단독 생성물에 대해 저작권이 인정되지 않을 수 있습니다. 이용자는 서비스 내에서 AI 생성 콘텐츠를 자유롭게 사용할 수 있으나, 상업적 이용 시에는 별도의 법률 자문을 권고합니다.
4. 이용자가 직접 작성한 일기 텍스트, 업로드한 사진 등의 저작권은 이용자에게 귀속됩니다.
5. AI 생성 콘텐츠가 의도치 않게 부적절한 내용을 포함할 수 있으며, 이용자는 이를 편집·삭제할 수 있습니다.
6. 회사는 이용자의 명시적인 동의 없이 이용자가 입력한 데이터(일기 텍스트, 사진 등)를 회사의 인공지능 모델 학습에 사용하지 않습니다. 외부 AI API를 사용하는 경우, 유료 API를 사용하여 데이터가 모델 학습에 사용되지 않도록 조치합니다.

제8조 (유료 서비스 및 결제)

1. 유료 서비스의 종류와 가격은 서비스 내에 표시됩니다.
2. 구독 (Pro 멤버십)
   • 월간 또는 연간 자동 갱신 방식이며, 구독 기간 종료 24시간 전까지 해지하지 않으면 자동 갱신됩니다.
   • 구독 해지는 Apple App Store 또는 Google Play Store의 구독 관리에서 가능합니다.
   • 구독 해지 시 남은 구독 기간까지 유료 기능을 이용할 수 있습니다.
3. 수프 (Soup) 구매
   • 수프는 AI 이미지 생성 등 특정 기능에 사용되는 인앱 화폐입니다.
   • 구매한 수프는 환불되지 않습니다 (단, 법률에서 정한 경우 제외).
   • 수프는 다른 이용자에게 양도할 수 없습니다.
4. 결제는 Apple App Store 또는 Google Play Store를 통해 이루어지며, 각 스토어의 결제 약관이 적용됩니다.

제9조 (환불 정책)

1. 구독 환불은 각 앱 스토어(Apple App Store, Google Play Store)의 환불 정책에 따릅니다.
2. 수프 구매 환불은 미사용분에 한하여 「전자상거래법」에 따라 구매일로부터 7일 이내에 요청할 수 있습니다.
3. 환불 시 이미 사용된 수프는 차감됩니다.
4. 부당한 환불 요청이 반복되는 경우(3회 이상), 회사는 서비스 이용을 제한할 수 있습니다.

제10조 (이용자의 의무)

이용자는 다음 행위를 하여서는 안 됩니다.

1. 타인의 개인정보를 도용하거나 허위 정보를 제공하는 행위
2. 서비스의 정상적인 운영을 방해하는 행위
3. 서비스를 이용하여 법령에 위반되는 행위를 하는 것
4. 서비스의 기술적 보호 조치를 무력화하거나 우회하는 행위
5. 자동화 도구를 이용하여 서비스에 비정상적으로 접근하는 행위
6. AI 생성 기능을 악용하여 불법·유해 콘텐츠를 생성하려는 행위

제11조 (서비스의 변경 및 중단)

1. 회사는 기술적 필요, 운영상 판단 등에 의해 서비스의 전부 또는 일부를 변경·중단할 수 있습니다.
2. 서비스 변경·중단 시 회사는 사전에 앱 내 공지 또는 이메일을 통해 이용자에게 안내합니다.
3. 무료 서비스의 변경·중단에 대해 회사는 별도의 보상 의무를 지지 않습니다.

제12조 (회원 탈퇴 및 계정 삭제)

1. 이용자는 언제든지 앱 내 설정(프로필 > 계정 삭제)을 통해 회원 탈퇴를 요청할 수 있습니다.
2. 탈퇴 시 이용자의 모든 개인정보, 일기, 이미지, 저장된 장소 등이 삭제됩니다.
3. 법령에 따라 보존이 필요한 정보(결제 기록 등)는 해당 기간 동안 보관 후 파기합니다.
4. 탈퇴 후 동일한 이메일로 재가입이 가능하나, 이전 데이터는 복구되지 않습니다.
5. 유료 서비스 이용 중 탈퇴하는 경우, 남은 구독 기간에 대한 환불은 각 앱 스토어의 정책을 따릅니다.

제13조 (개인정보 보호)

이용자의 개인정보 보호에 관한 사항은 별도의 개인정보 처리방침에 따릅니다.

제14조 (면책 조항)

1. 회사는 천재지변, 전쟁, 기간통신사업자의 서비스 중지 등 불가항력으로 인한 서비스 제공 불가에 대해 책임을 지지 않습니다.
2. 회사는 AI 생성 콘텐츠의 정확성, 신뢰성, 적합성에 대해 보증하지 않으며, AI 생성 콘텐츠로 인한 손해에 대해 책임을 지지 않습니다.
3. 회사는 이용자의 귀책 사유로 발생한 서비스 이용 장애에 대해 책임을 지지 않습니다.
4. 오늘의 운세 기능은 오락 목적으로만 제공되며, 의사결정의 근거로 사용할 수 없습니다.
5. 건강 데이터 표시는 정보 제공 목적이며, 의료적 진단이나 조언을 대체하지 않습니다.

제15조 (손해배상)

1. 회사 또는 이용자가 이 약관을 위반하여 상대방에게 손해를 입힌 경우, 그 손해를 배상할 책임이 있습니다.
2. 회사의 손해배상 범위는 이용자가 회사에 지불한 서비스 이용료를 상한으로 합니다 (법령에서 달리 정한 경우 제외).

제16조 (분쟁 해결)

1. 이 약관에 관한 분쟁은 대한민국 법률을 준거법으로 합니다.
2. 서비스 이용과 관련한 분쟁은 회사의 본사 소재지를 관할하는 법원을 전속 관할 법원으로 합니다.
3. 이용자는 전자거래 관련 분쟁에 대해 전자거래분쟁조정위원회(www.ecmc.or.kr)에 분쟁 조정을 신청할 수 있습니다.

부칙

이 약관은 2026년 4월 1일부터 시행합니다.

Terms of Service

Article 1 (Purpose)

These Terms of Service ("Terms") govern the rights, obligations, and other necessary matters between ARE CREATIVE HUB Co., Ltd. ("Company") and users ("User") regarding the use of the Gamja Diary (AutoPixel) service ("Service").

Article 2 (Definitions)

1. "Service" means all features of the Gamja Diary app, including AI diary generation, AI image generation, timeline recording, health and calendar integration.
2. "User" means any person who uses the Service under these Terms.
3. "AI-Generated Content" means diary text, images, fortunes, and other content automatically generated using external AI APIs.
4. "Soup" means the in-app currency used within the Service.
5. "Paid Service" means services requiring payment, including subscriptions (Pro membership) and Soup purchases.

Article 3 (Effectiveness and Modification)

1. These Terms become effective when posted within the Service or otherwise notified to Users.
2. The Company may modify these Terms within the scope permitted by applicable laws, and will post the modified Terms within the Service at least 7 days before the effective date.
3. For changes unfavorable to Users, the Company will provide at least 30 days' advance notice and individually notify Users via email or in-app notification.
4. If the Company clearly notifies Users that failure to express refusal by the effective date will be deemed consent, and the User does not express refusal by the effective date, the User is deemed to have consented to the modified Terms.
5. Users who do not agree to the modified Terms may express refusal and terminate the service agreement before the effective date.

Article 4 (Registration and Account)

1. Users may register via email or social login (Google, Apple).
2. Users must provide accurate information. Registration using another person's information is prohibited.
3. Users under 14 years of age may not register for the Service.
4. Users are responsible for maintaining the security of their account and may not transfer or lend it to others.

Article 5 (Service Description)

1. AI Diary Generation: AI automatically generates diary entries based on the User's timeline, calendar, health data, and photos.
2. AI Image Generation: AI generates illustrated diary images based on diary content.
3. Timeline Recording: Automatically records the User's location movements to summarize the day's journey.
4. Daily Fortune: AI generates fortunes based on User-provided name, gender, and date of birth.
5. Data Integration: Health data (steps, sleep) and calendar events are integrated into diary content.

Article 6 (Company Obligations)

1. The Company shall not engage in activities prohibited by applicable laws or contrary to public morals, and shall make its best efforts to provide continuous and stable service.
2. The Company shall maintain security systems to protect personal information and shall publish and comply with its Privacy Policy.
3. The Company shall address user opinions and complaints deemed legitimate, and communicate the process and results via in-app support or email.
4. The Company shall not send unsolicited commercial communications to Users.
5. The Company shall maintain and repair the facilities necessary for service provision and endeavor to promptly restore service in case of disruption.

Article 7 (AI-Generated Content)

1. AI-Generated Content is produced automatically via external AI APIs. The Company does not guarantee its accuracy, completeness, or suitability.
2. AI-generated diary entries and images are labeled as "Generated by AI."
3. Under current Korean copyright law, AI-generated content produced solely by AI may not be eligible for copyright protection. Users may freely use AI-Generated Content within the Service, but are advised to seek legal counsel for commercial use.
4. Copyright for User-created content (diary text, uploaded photos) belongs to the User.
5. AI-Generated Content may unintentionally contain inappropriate content. Users may edit or delete such content.
6. The Company does not use data entered by Users (diary text, photos, etc.) for training its own AI models without explicit consent. When using external AI APIs, the Company uses paid API tiers to ensure data is not used for model training.

Article 8 (Paid Services and Payment)

1. Types and prices of Paid Services are displayed within the Service.
2. Subscriptions (Pro Membership)
   • Monthly or annual auto-renewing. Unless cancelled at least 24 hours before the end of the current period, it will automatically renew.
   • Cancellation is managed through Apple App Store or Google Play Store subscription settings.
   • Upon cancellation, paid features remain available until the end of the current billing period.
3. Soup Purchases
   • Soup is in-app currency used for AI image generation and other specific features.
   • Purchased Soup is non-refundable except as required by law.
   • Soup is non-transferable to other Users.
4. Payments are processed through Apple App Store or Google Play Store, subject to each store's payment terms.

Article 9 (Refund Policy)

1. Subscription refunds are subject to the refund policies of the respective app store (Apple App Store, Google Play Store).
2. Soup purchase refunds may be requested within 7 days of purchase for unused portions, in accordance with the E-Commerce Act.
3. Already-used Soup will be deducted upon refund.
4. Repeated fraudulent refund requests (3 or more) may result in service restrictions.

Article 10 (User Obligations)

Users shall not:

1. Misappropriate others' personal information or provide false information
2. Interfere with the normal operation of the Service
3. Use the Service to engage in activities that violate laws or regulations
4. Circumvent or disable the Service's technical protection measures
5. Use automated tools to access the Service abnormally
6. Misuse AI generation features to create illegal or harmful content

Article 11 (Service Modification and Suspension)

1. The Company may modify or suspend all or part of the Service due to technical necessity or operational judgment.
2. Users will be notified in advance via in-app notice or email.
3. The Company bears no compensation obligation for changes or suspension of free services.

Article 12 (Membership Withdrawal and Account Deletion)

1. Users may request account deletion at any time through in-app settings (Profile > Delete Account).
2. Upon deletion, all personal data, diary entries, images, and saved places are permanently removed.
3. Legally required information (payment records, etc.) is retained for the required period before destruction.
4. Re-registration with the same email is possible, but previous data cannot be recovered.
5. If a User deletes their account during an active paid subscription, refunds are subject to the respective app store's policy.

Article 13 (Privacy)

Protection of User's personal information is governed by the separate Privacy Policy.

Article 14 (Disclaimer)

1. The Company is not liable for service disruptions caused by force majeure events including natural disasters, war, or telecommunications provider outages.
2. The Company does not guarantee the accuracy, reliability, or suitability of AI-Generated Content and is not liable for damages arising from it.
3. The Company is not liable for service disruptions caused by the User's own fault.
4. The Daily Fortune feature is provided for entertainment purposes only and should not be used as a basis for decision-making.
5. Health data display is for informational purposes only and does not replace medical diagnosis or advice.

Article 15 (Damages)

1. If either party violates these Terms and causes damage to the other, the violating party is responsible for compensation.
2. The Company's liability is limited to the amount of service fees paid by the User, except as otherwise required by law.

Article 16 (Dispute Resolution)

1. These Terms are governed by the laws of the Republic of Korea.
2. Disputes related to the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Company's principal place of business.
3. Users may apply for dispute mediation through the Electronic Commerce Mediation Committee (www.ecmc.or.kr).

Supplementary Provisions

These Terms are effective as of April 1, 2026.
